Contested Cases
The Debtor filed a Chapter 13 bankruptcy to protect his truck and trailer from creditors. The Debtor’s trailer was his home. Prior to the filing of his bankruptcy the Debtor became disabled and sold his homestead. He used the proceeds of the sale of his homestead to invest in various online money making opportunities. He also purchased a truck and trailer that he began using as his home. The Trustee opposed confirmation arguing that the case was not filed in good faith because the Debtor had expended all of his savings prior to filing. The Judge took into consideration that the Debtor was a disabled veteran and that his sole source of income at the time of filing was Social Security Disability Income. The Judge, in what he mentioned was a close decision, over ruled the Chapter 13 Trustee’s objection and confirmed the Chapter 13 bankruptcy plan.
The Debtor lost his dental practice after a divorce and major medical issues. The Debtor began working as a dentist on a contract basis and then filed Chapter 7 bankruptcy. The Debtor’s income at the time the Chapter 7 was filed was too much to ‘pass’ the means test. The Debtor argued that his student loans were non-consumer debts, making more than half of his total debts non-consumer (exempting him from the means test requirement).The Judge ruled that because the Debtor went to dental school for the purposes of starting his own dental business, the portion of the Debtor’s student loans that were actually used for tuition, books and fees was not consumer debt. With this ruling more than half of the Debtor’s total debts were considered non-consumer debts and the Debtor received his Chapter 7 discharge. The Debtor had a previous Chapter 13 bankruptcy dismissed due to missed bankruptcy plan payments. The Debtor filed a second Chapter 13 bankruptcy and the mortgage company contested the Debtor’s “Motion to Extend the Automatic Stay.” The mortgage company argued that the Debtor filed bankruptcy twice after receiving notice of a pending foreclosure sale date. The mortgage company also argued that the Debtor’s budget was too thin and would likely result in a second dismissal due to missed bankruptcy plan payments.The Debtor responded that her circumstances had changed. The Debtor argued that her employment was more stable during the pendency of the second case and that the Debtor’s mother would help the Debtor financially as needed in months where the Debtor’s income from employment would fluctuate due to changes in hours.
In a close call, the Judge granted the motion and extended the automatic stay with conditions. The automatic stay was conditioned upon the Debtor being current on her bankruptcy plan payments at the end of each calendar month. The conditions allowed for the mortgage company to file an affidavit lifting the stay in any month where the Debtor was not current at the end of the calendar month.
The Debtors filed Chapter 13 bankruptcy. After almost two years of timely payments under their Chapter 13 bankruptcy plan, the husband suffered severe illness causing him to be unable to work. Prior to his illness, the husband had worked two jobs and was the primary source of household income.At the time that their Chapter 13 bankruptcy was filed, Mr. and Mrs. Lowry were ineligible for a Chapter 7 bankruptcy due to a previously discharged Chapter 7 bankruptcy case. The Debtors were not eligible to convert to a Chapter 7 case and could not afford to make further payments in a Chapter 13 bankruptcy. A motion for a hardship discharge was filed. After considering the facts of the case, a hardship discharge was granted by the Judge. Please note that some of the above “Contested Cases” were clients of The Schachter Law Firm, P.C.. Ryan Dove (now of Dove Law Firm, PLLC) was the attorney in charge for each case and conducted the trial and/or hearing in each case.

Chapter 7 Cases
Deer Park, Texas married couple sought advice and one spouse filed Chapter 7 bankruptcy. The client was able to keep his property and discharged over $70,000 in unsecured debt (most of which were unexpected medical bills). The client did not have to give up any of his stuff as a part of the Chapter 7 bankruptcy.
Missouri City, Texas married couple filed Chapter 7 bankruptcy after the husband lost his job and they were sued for an unpaid debt. The clients were able to discharge $40,000 in unsecured debt and to get out from under a car note with a very high monthly payment. As a part of the Chapter 7 bankruptcy process, a judgment lien against the clients was wiped out.
Houston, Texas resident filed Chapter 7 bankruptcy after an unexpected reduction in income. The client was able to keep her car and to keep making payment and was able to wipe out over $18,000 in unsecured debt.
Houston, Texas resident filed Chapter 7 bankruptcy after being sued by debt collectors for unpaid debts. She depended on family members for support and was able to discharge over $18,000 in unsecured debt while keeping her home.

Spring, Texas resident filed Chapter 7 bankruptcy after falling behind on credit card payments (and being sued by a debt collector) while going back to school. The Chapter 7 discharged over $40,000 in unsecured debt and voided a judgment lien.
Houston, Texas resident filed Chapter 7 bankruptcy as a result of a divorce and a failed business. The client was able to discharge over $159,000 in unsecured debt (most of which was a result of the business having to be closed) and was able to void a judgment lien.
Rosenberg, Texas residents filed a Chapter 7 bankruptcy after being sued by a debt buyer. The bankruptcy stopped the lawsuit. The Debtors discharged over $101,000 in unsecured debt. The client did not have to give up any of his property as a part of the Chapter 7 bankruptcy.
Houston, Texas resident filed Chapter 7 bankruptcy after being sued by a creditor. The client discharged over $235,000 in unsecured debt (most of which was from medical bills). The client did not have to give up any of his property as a part of the Chapter 7 bankruptcy.

In exchange for the discharge in the Chapter 7 bankruptcy the client was required to turn over $3,695.02 from a tax return and the sale of a few shares of stock (the client knew this before the case was filed).

The filing of the Chapter 7 bankruptcy also stopped a lawsuit that had been filed against the clients by a debt collector. The client filed bankruptcy after having to retire after being laid off and was unable to find work.
